Terms of Service

By accessing or using the Service, you confirm that you can form a binding contract with Destall and that you are agreeing to these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization, and “you” means the organization.

You must be at least 16 years old to use the Service. If you are under the age where consent is required in your jurisdiction to process personal data, you must have your parent or legal guardian’s permission. You may not use the Service if you are barred from doing so under applicable law.

You are responsible for any activity that occurs under your account. Keep your credentials secure and notify us immediately of any unauthorized use or security breach. We may require additional verification before enabling certain features or completing account changes.

Some features require a paid subscription. Prices, features, and limits for each plan are described at purchase. Unless stated otherwise, subscriptions auto-renew at the end of each billing cycle and you authorize us (or our payment processor) to charge your payment method. You can cancel at any time; cancellations take effect at the next renewal date. Taxes may be added depending on your billing address.

If you sign up for a free trial, access continues until the end of the trial period or until you upgrade or cancel. At trial end, your subscription may convert to a paid plan unless you cancel before renewal. We reserve the right to modify or end trials at any time.

You agree not to misuse the Service. For example, you will not:

• Scrape, crawl, or harvest data in violation of platform terms or applicable law.
• Spam, run unsolicited outreach at scale, or harass other users or third parties.
• Attempt to bypass rate limits, security controls, or platform API restrictions.
• Upload or transmit malware, or interfere with proper operation of the Service.
• Use the Service to break the law or infringe third-party rights (including IP and privacy).

We may investigate and suspend or terminate accounts for violations.

You may submit, link, or manage content through the Service (“User Content”). You retain ownership of your User Content. You grant Destall a worldwide, non-exclusive, royalty-free license to host, process, display, and transmit your User Content solely to provide and improve the Service. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate these Terms or any law.

Destall and its licensors own all rights in the Service, including software, documentation, designs, and branding. Except for the limited rights expressly granted, we reserve all other rights.

Destall integrates with third-party platforms (e.g., Reddit, X, LinkedIn) and other tools. Your use of those platforms is subject to their terms and policies. We aren’t responsible for third-party services, content, or actions. Integrations may change or stop working at any time due to third-party changes or rate limits.

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to our data practices. Where required, we will execute additional data processing terms with you (e.g., a DPA) for business or enterprise plans.

From time to time, we may offer features identified as alpha, beta, preview, or otherwise not yet generally available. These features are provided “as is,” may be changed or discontinued at any time, and may be subject to additional rules.

We may suspend or terminate your access if you violate these Terms, if your use poses a risk to the Service or others, or for non-payment. You may stop using the Service at any time. Upon termination, your license ends and you must stop using the Service. Certain sections survive termination (including those on IP, disclaimers, liability limits, indemnification, and governing law).

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Destall disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that results will be accurate or reliable.

To the fullest extent permitted by law, Destall, its affiliates, and their respective directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim is limited to the greater of (a) amounts you paid to Destall for the Service in the 12 months before the event giving rise to the claim, or (b) $100.

You agree to defend, indemnify, and hold harmless Destall and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with (a) your use of the Service, (b) your User Content, or (c) your breach of these Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.

We may update these Terms from time to time. If we make material changes, we’ll provide reasonable notice (e.g., by posting to our site or emailing you). Changes apply on the effective date indicated. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
